Bribery of a Public Officials or Jurors

Statute
18 USC 201(b)(1). Bribery of Public Official (or Juror)

(b) Whoever—

(1) directly or indirectly, corruptly gives, offers or promises anything of value to any public official or person who has been selected to be a public official, or offers or promises any public official or any person who has been selected to be a public official to give anything of value to any other person or entity, with intent—

  1. to influence any official act; or
  2. to influence such public official or person who has been selected to be a public official to commit or aid in committing, or collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the United States; or
  3. to induce such public official or such person who has been selected to be a public official to do or omit to do any act in violation of the lawful duty of such official or person;

Jury Instruction
The Defendant can be found guilty of that offense only if all of the following facts are proved beyond a reasonable doubt:

  1. That the Defendant directly or indirectly gave or offered or promised something of value to a public official or juror, as charged; and
  2. That the Defendant did so knowingly and corruptly, with intent {to influence an official act} {to influence such public official to allow or make opportunity for the commission of a fraud on the United States} {to induce such public official to omit an act in violation of the public official’s lawful duty}.

The term “official act” means any decision or action on any question, matter, cause, suit, proceeding, or controversy which is brought before a public official or juror for a decision or to be acted upon.

To act “corruptly” means to act knowingly and dishonestly for a wrongful purpose.
