18 USC 1324(a)(1)(A)(i). Bringing in Aliens

(a) Criminal penalties
(1)
(A) Any person who—
(i) knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;

Jury Instruction
The Defendant can be found guilty of that offense only if all of the following facts are proved beyond a reasonable doubt:

  1. That the Defendant knowingly brought or attempted to bring into the United States the person named in the indictment;
  2. That such person was then an alien;
  3. That the Defendant knew such person to be an alien; and
  4. That entry into the United States was made or attempted at a place other than a designated port of entry

An alien is any person who is not a natural-born or naturalized citizen, or a national of the United States. The term “national of the United States” includes not only a citizen but also a person who, though not a citizen of the United States, owes permanent allegiance to the United States.
