Federal- Possession of Firearm having Altered or Obliterated Serial Number

Statute
26 USC 5861(h). Possession of Firearm Having Altered or Obliterated Serial Number

It shall be unlawful—
(h) to receive or possess a firearm having the serial number or other identification required by this chapter obliterated, removed, changed, or altered.

Jury Instruction
The Defendant can be found guilty of that offense only if all of the following facts are proved beyond a reasonable doubt:

  1. That the Defendant, at the time and place charged in the indictment, knowingly possessed the “firearm” described in the indictment;
  2. That the “firearm” serial number had been obliterated or altered; and
  3. That the Defendant knew that the serial number had been obliterated or altered.
