Carrying/Possessing a Firearm During or in Furtherance of a Drug Offense

Carrying/Possessing a Firearm During or in Furtherance of a Drug Offense - provides for a fixed mandatory prison term for anyone who uses or carries a firearm during and in relation to any crime of violence or drug trafficking crime, or who possesses a firearm in furtherance of such an offense. The mandatory minimum penalty for the basic offense is 5 years; if the firearm is a short-barreled rifle or shotgun or semiautomatic assault weapon, 10 years; if a machine gun, destructive device, or firearm equipped with a silencer, 30 years. For second or subsequent convictions the penalty is 25 years, and if the firearm is a machine gun, etc., life imprisonment without release.
